As your CARB compliance partner, NECS has continued to research all other states that may adopt CARB regulations. Two states have recently enacted initiatives in regard to emissions, while two other states have repealed their requirements and no longer require reporting.

ARIZONA and FLORIDA have both repealed their CARB reporting requirements.
COLORADO: The Colorado Department of Public Health & Environment is now enforcing a deadline on a one-time fleet reporting requirement called the Large Entity Reporting (LER) requirement. According to the CO Department of Public Health & Environment, the purpose of this reporting requirement is to assess the suitability of zero emission vehicles in multiple use cases and to inform future strategies for the zero-emission vehicle market in Colorado. This initiative reporting deadline is July 1, 2025, with another deadline due on Dec. 31, 2027. This initiative is applicable to:
Any fleet owner in the tax year preceding each reporting year that had 20 or more vehicles with a GVWR greater than 8,500 lbs. under common ownership or control and operated a facility in Colorado.
OR
Any broker or entity that dispatched 20 or more vehicles with a GVWR greater than 8,500 lbs. into or throughout Colorado, and operated a facility in Colorado, in the tax year preceding each reporting year.
The Large Entity Reporting is very similar to other states who have adopted similar regulations, including New York, New Jersey, and Massachusetts.
NEW MEXICO: Introduced by the New Mexico Environment Department (NMED), New Mexico has rolled out a one-time reporting requirement called theLarge Entity Reporting Requirement (LERR). This applies to businesses and government entities that operate, own, or dispatch medium- or heavy-duty vehicles (8,500 lbs. GVWR or more) in the state. The report is due by May 1, 2025. Submissions are still accepted/required after this deadline
The data collected will be used by the state to:
Support the rollout of low- and zero-emission vehicles
Develop future vehicle incentive programs
Inform infrastructure and workforce investment
Help reduce emissions across New Mexico
You may be required to file if any of the following apply:
You are a government agency (federal, state, or local – excluding schools) operating qualifying vehicles in NM
Your business has over $50 million in annual U.S. revenue (2023 or 2024) and operated a facility in NM with one or more qualifying vehicles
You operated a facility in NM and had control over 50 or more qualifying vehicles
You are a broker or dispatcher operating in NM who dispatched 50 or more qualifying vehicles
